CITY OF LENOX

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on November 8, 2021 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Brown, Tull, Zabel and Cruz. Staff present was City Administrator, Allison Kitzman and City Clerk, Dawne Bowman; others present were Clay Nelson, Linda Hogan and Colleen Larimer.

Bowman made a motion to approve the agenda, seconded by Brown, all ayes, motion carried. Brown made a motion to approve 10/25/21 meeting minutes, seconded by Tull, all ayes, motion carried. Brown made a motion to approve the payment of bills, seconded by Tull, all ayes, motion carried. Zabel made a motion to approve October 2021 Clerk Treasurer Report, seconded by Brown, all ayes, motion carried.

At 5:30 PM Tull opened the Public Hearing 28E Agreement with City of Prescott to Provide Natural Gas Services, seconded by Brown. There were no comments heard from the public. Brown closed the Public Hearing at 5:32 PM, seconded by Cruz.

Zabel made a motion to approve Resolution 21- 45 28E Agreement with City of Prescott to Provide Natural Gas Services, seconded by Bowman, all ayes, motion carried.

Kitzman discussed library repairs. The lead samples from the tin ceiling paint came back positive. The Library Board has agreed to use their Special Funds to remove the paint and repaint the ceiling. The back wall needs to be painted, then the project should be complete.

There was a discussion on the dump truck that was approved for purchase, pending inspection, at the last meeting. Kitzman stated that the previous dump truck had a lot of rust on the box and decided not purchase it. Public Works continued looking for another truck. Bowman made a motion to approve the purchase of 2010 International 7600 Tandem Dump Truck in the amount of $38,000, using RUT funds, seconded by Brown. Kitzman added that this is a one owner truck with 76,000 miles on it and has a 14ft stainless steel bed.

There was a brief discussion on City Hall repairs, as the signage for the front of the building is complete and are currently waiting on the new windows. The council was given 2 samples of colors for the new awnings, in which Captain Navy was chosen. Kitzman added that there will also be lights over the signs on the building.

At 5:45 PM Bowman opened the Public Hearing 2021 Amendment to Urban Renewal Plan for Economic Development Urban Renewal Area and the Development Agreement with Dalton Ag Enterprises, seconded by Tull. There were no comments heard from the public. At 5:47 PM Bowman closed the Public Hearing, seconded by Tull.

Bowman made a motion to approve Resolution 21- 46 2021 Amendment to Urban Renewal Plan for Economic Development Urban Renewal Area and the Development Agreement with Dalton Ag Enterprises, seconded by Brown, all ayes, motion carried.

There was a discussion on Community Center rental fees, deposits and cleaning. The current agreement has a list of items that are to be cleaned in order for the deposit to be refunded. There are instances in which this does not happen. Linda Hogan was present and commented that occasionally there is candy/gum stuck to the floors or the building is left with very little cleaning done; however, it is reported to City Hall when this happens. Kitzman added that in order for any deposit to be withheld, City Hall personnel would need to have some proof, such as pictures or a checklist of items that were not completed to show the renter. Hogan agreed to complete a checklist of any items that were not cleaned and return it to City Hall. There was also a discussion on people renting the small room due to the price, but ultimately utilizing the whole building. It was decided that the new change in the small room rental would most likely take care of this issue. Brown made a motion to approve Resolution 21- 44 Establishing Community Center Fees, seconded by Tull, all ayes, motion carried. This resolution states that the small room of the Community Center is only available for rent Monday through Friday until noon effective immediately.

The Hometown Housing will be on the next agenda.

Brown motioned to adjourn the meeting, Tull seconded, all ayes, motion carried. Meeting adjourned at 6:10 P.M.
