CITY COUNCIL REGULAR MEETING MINUTES

October 26, 2020 · 5:30 p.m. · City Hall

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on October 26, 2020 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Brown, Tull, Zabel; Cruz was absent. Staff present was City Administrator, Allison Kitzman and City Clerk, Dawne Bowman. Colleen Larimer and Jeff Godwin with Snyder & Associates were present.

Bowman made a motion to approve the agenda, seconded by Brown, all ayes, motion carried. Brown made a motion to approve 10/12/20 meeting minutes, seconded by Tull, all ayes, motion carried. Tull made a motion to approve the payment of the bills, seconded by Brown, all ayes, motion carried.

Jeff Godwin with Snyder & Associates was present to discuss the final inspection of the SRF Golf Course Grade Stabilization project, as it is complete and signed off. Zabel made a motion to approve Change Order #1 for SRF Sponsored Project Golf Course Grade Stabilization as a credit of $6,545.90, as there were some items not needed, seconded by Bowman, all ayes, motion carried.

Bowman made a motion to approve Pay Request #1 in the amount of $43,790.97 SRF Sponsored Project Golf Course Grade Stabilization, seconded by Tull, all ayes, motion carried.

Brown made a motion to approve Resolution 20- 45 Accepting work for Golf Course Grade Stabilization Sponsored Project, seconded by Tull, all ayes, motion carried.

Kitzman discussed 6 Certificate of Deposits that are coming due, stating that she does not foresee the interest increasing and would like the CD's to be 6- month, rather than 90 days, as they have been in the past. Brown made a motion to approve Resolution 20- 38 Regarding ISSB Certificate of Deposits, seconded by Bowman, all ayes, motion carried.

Tull made a motion to approve Class C Liquor License Beer/Wine for Tiger Lanes, seconded by Brown, all ayes, motion carried.

Bowman made a motion to approve Resolution 20- 39 Approving Contract and Bonds for City of Lenox- Public Library Exterior Renovations, seconded by Brown. Roll call votes- all ayes, Zabel nay, motion carried.

Kitzman discussed FY21 City Budget Amendment #1 for library repairs and for the Pocket Park. Bowman made a motion to approve Resolution 20- 41 Setting Time and Date of 11/23/20 at 5:30 PM for FY21 City Budget Amendment #1, seconded by Brown, all ayes, motion carried.

Brown made a motion to approve CDBG Draw #10 PPLC in the amount of $21,269, seconded by Tull, all ayes, motion carried.

At 5:45 PM Bowman opened the Public Hearing on Proposal to enter into an amended Sewer Revenue Loan and Disbursement Agreement, seconded by Brown. There were no comments heard from the public. At 5:45 PM, Bowman closed the Public Hearing, seconded by Brown, all ayes, motion carried.

Kitzman discussed the recent SRF projects (Bioswale, Wetland and Golf Course Grade Stabilization), as these projects were completed through the original Wastewater Treatment Plant upgrade. Zabel made a motion to approve Resolution 20- 40 Authorizing and Approving and amended Loan and Disbursement Agreement and providing for the issuance and securing the payment of $194,000 Sewer Revenue Bonds, Series 2020, seconded by Brown. Roll call vote- all ayes, motion carried.

Tull made a motion to approve Resolution 20- 44 Providing for reduction of interest rate on Sewer Revenue Bond, SRF Series 2017, dated November 17, 2017 in connection with the financing of certain water resource restoration projects, seconded by Brown. Roll call vote- all ayes, motion carried.

Zabel motioned to approve Annual Financial Report FY20- 21, seconded by Brown, all ayes, motion carried.

Bowman made a motion to approve Resolution 20- 42 Authorizing payment to Lenox Development Corporation in the amount of $1,225, seconded by Tull, all ayes, motion carried.

Tull made a motion to approve Resolution 20- 43 Setting Time and Date of 11/09/20 at 5:45 PM for public hearing on proposal to enter into a General Obligation Library Improvement Loan Agreement and to borrow money thereunder in a principal amount not to exceed $350,000, seconded by Brown, all ayes, motion carried.

Brown moved to adjourn the meeting, Tull seconded, all ayes, motion carried. Meeting adjourned at 6:05 P.M.
