CITY OF LENOX

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on September 25, 2017 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Adams, Vogel, Borland and Custer. Staff present included City Administrator, Allison Kitzman, City Clerk, Dawne Bowman and Public Works, Ryan Brown. Other visitors were Coleen Larimer and Deputy Pafford.

Bowman made a motion to approve the agenda, seconded by Custer, all aye, motion carried. Adams made a motion to approve 9/11/17 meeting minutes, seconded by Borland all aye, motion carried. Custer made a motion to approve the payment of the bills, seconded by Vogel, all ayes, motion carried.

At 5:30 PM a Public Hearing was held on Plans, Specifications, Form of Contract and Estimate of Cost for the Lenox Wastewater Treatment Plant Improvement Project. There were no comments from the public. At 5:31 PM, Adams made a motion to close the Public Hearing, seconded by Vogel, motion carried.

Borland made a motion to approve 3rd final Reading Ordinance 376- adding new chapter to address On- Site Storage Containers, seconded by Bowman. Roll call votes, Custer and Adams- nay, Borland, Vogel and Bowman- aye, motion carried.

Bowman made a motion to approve 2nd Reading Ordinance 377 Amending Sewer Service Charges, seconded by Custer, all aye, motion carried.

Discussion was held on parking on West Ohio Street at Brooks Street. It was decided to move the No Parking Here to Corner back another 35 feet from Brooks Street corner.

Custer motioned to approve Resolution 17- 28 Approving Plans, Specifications, and Form of Contract for the Lenox Wastewater Treatment Plant Improvement Project, seconded by Bowman, all ayes, motion carried.

Discussion was held on the bids received for the Wastewater Treatment Plant Improvement Project. There were 3 bids received, CL Carroll Co., Inc. in the amount of $2,487,348, Building Crafts Inc. in amount of $3,098,500 and Industrial Process Technology in the amount of $3,497,000.

Adams made a motion to approve Resolution 17- 29 Awarding Contract for Lenox Wastewater Treatment Plant Improvement Project to CL Carroll Co., Inc. in the amount of $2,487,348 and $198 per ton for sludge removal and disposal, seconded by Borland, all ayes, motion carried.

Vogel approved Resolution 17- 27 for Application of ATURA Grant for Walking Trail, seconded by Adams, all ayes, motion carried.

Custer made a motion to approve submission of additional TAP funds application, seconded by Borland, all ayes, motion carried.

Borland made a motion to approve Snyder and Associates Supplemental Agreement for additional services in amount of $1,750 for the Walking Trail project, seconded by Adams, all ayes, motion carried.

Custer made a motion to approve Resolution 17- 26 Transfer of Sports Complex Funds in amount of approximately $1,896.65 to close account, seconded by Bowman, all ayes, motion carried.

Adams approved Resolution 17- 30 Transfer of Funds (Depot Cash- $123.56 and Industrial Site $2,800.11) to General Cash Account (Special Assessment- $8,693.13 to Roads Money Market, seconded by Custer, all ayes, motion carried. Kitzman stated these are accounts that have had no activity in several years.

Vogel made a motion to approve Resolution 17- 31, Tax Abatement for 107 East Nebraska, seconded by Bowman, all ayes, motion carried.

Bowman made a motion to re- appoint Tom Borland to the Zoning Board for a term of 5 years, expiring 10/2022, seconded by Custer, all ayes, motion carried.

There was a discussion held on the 1981 dump truck. Kitzman and Brown discussed the need to replace this truck, as it would be costly to repair. Brown has been in contact with IA DOT regarding the purchase or availability of dump trucks. Brown added the 1975 yellow fire truck is also needing to be sold, as it is of no use to the City. It is not in operating condition at this time, due to brake lines being broken. Custer made a motion to approve the selling of 1981 dump truck and 1975 fire truck in sealed bids with minimum bid of $500 per vehicle, seconded by Bowman, all ayes, motion carried.

Adams moved to adjourn the meeting, Custer seconded, all ayes, motion carried. Meeting adjourned at 6:05 P.M.
