CITY OF LENOX

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on June 26, 2017 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Adams, Vogel, Borland and Custer. Staff present included City Administrator, Allison Kitzman, City Clerk, Dawne Bowman, Public Works, Ryan Brown. Other visitors were Deputy Pafford, Chad Halupnick, Jesse Sheley, Courtney Brown, and Coleen Larimer.

Bowman made a motion to approve the agenda, seconded by Borland, all aye, motion carried. Adams made a motion to approve 6/12/17 meeting minutes, seconded by Vogel all aye, motion carried. Bowman made a motion to approve 6/19/17 special meeting minutes, seconded by Custer, all aye, motion carried. Bowman made a motion to approve the payment of the bills, seconded by Borland, all aye, motion carried.

Chad Halupnick with DCI Group presented the Council with the Capital Improvement Plan, which consists of all city buildings and any repairs needed, as well as the year to be completed and a dollar amount to budget for these repairs.

There was a discussion on the fireworks ordinance. Courtney Brown was present to discuss her concern of allowing fireworks to be discharged in city limits, as she has experienced several late night fireworks going off in her neighborhood and is concerned for the safety of her home, as well as it being a disruption to her family. Brown has been in contact with her homeowner's insurance company and was advised that at this time homes are covered, but as fireworks become more popular, homes will not be covered if they were to be damaged by fireworks. Deputy Pafford discussed a discrepancy in the current City Code vs. the State of Iowa Code.

Borland made a motion to approve 1st reading of Ordinance 371 amending the Fireworks Code, allowing fireworks to be discharged in city limits on July 1st through July 5th from 9AM until 10PM and with extended hours until 11PM on the 4th only and on December 30th through January 2nd from 9AM until 10PM with extended hours of 12:30AM on January 1st only. Anyone discharging fireworks except during these time frames could be fined up to $750.00. This motion was seconded by Vogel. Roll call votes- Adams, Custer- nay, Borland, Vogel and Bowman- aye, motion carried.

Vogel made a motion to waive the 2nd and 3rd readings of Ordinance 371, amending the Fireworks Code, seconded by Borland. Roll call votes- Bowman, Borland, Vogel, and Adams- aye, Custer- nay, motion carried.

Custer made a motion to approve Resolution 17- 17 Participate in Planning and Development Programs of SICOG, seconded by Borland, all aye, motion carried.

Custer made a motion to approve Liquor License for Dally Post Saloon, LLC, seconded by Bowman, all aye, motion carried.

Borland made a motion to approve Special Events Permit for Dally Post and Stock and Saddle Club for street dance, seconded by Adams, all aye, motion carried.

A discussion of on- site storage containers was held. Jesse Sheley was present to discuss his container and his willingness to purchase a building permit for it and move it wherever the council desires in order to keep it. It was the consensus of the council to not allow on- site storage containers in residential zoned areas. Sheley provided the council with pictures of random sheds in town that are more unsightly than his shed, and commented that his metal container will last longer and hold up in weather better than a wood shed. Bowman offered to allow Sheley to be grandfathered in, as this ordinance was not in affect when he purchased his and seems it's unfair to make him remove it. Adams and Custer stated their concern of grandfathering and would prefer the council to draw a line somewhere, rather than risk having other containers in town.

Custer made a motion to approve 1st reading of Ordinance 373 restricting on- site storage containers in residential zoned areas, seconded by Adams. Roll call votes- all ayes, Borland- nay, motion carried.

Adams made a motion to approve Resolution 17- 18 Authorizing Bids for Neighborhood Center Building Addition, seconded by Custer, all aye, motion carried.

Deputy Pafford reported for the Sheriff's Department, discussing upcoming 4th of July activities in Clearfield and New Market, as well as rodeo activities later in July.

Adams moved to adjourn the meeting, Custer seconded, all ayes, motion carried. Meeting adjourned at 6:40 P.M.
