City Council Regular Meeting Minutes

A regular meeting of the Lenox City Council was called to order by Mayor Douglas on September 24, 2018 at 5:30 p.m. at City Hall with the following council members answering roll call: Bowman, Ramsey, Vogel, Borland; Custer was absent. Staff present was City Administrator, Allison Kitzman, City Clerk, Dawne Bowman and City Attorney, Andrew Zimmerman. Other visitors were Sandy Marshall, Tyson Brown, Megan Weeks, Karen Zabel and Colleen Larimer.

Bowman made a motion to approve the agenda, seconded by Ramsey, all ayes, motion carried.

Borland made a motion to approve 9/10/18 meeting minutes, seconded by Bowman, all ayes, motion carried. Vogel made a motion to approve the payment of the bills, seconded by Ramsey, all ayes, motion carried. Vogel made a motion to approve August 2018 Clerk Treasurer Report, seconded by Borland, all ayes, motion carried.

Borland made a motion to approve October 31, 2018 as Beggars Night, seconded by Bowman, motion carried.

Bowman made a motion to approve Don Cox to the Park/Rec/Pool Board for a term of 2 years, ending 9/2020, seconded by Ramsey, all ayes, motion carried.

Vogel made a motion to approve final pay application to Pro-Line Building for Neighborhood Center Addition in the amount of $4,256.65, seconded by Ramsey, all aye, motion carried.

Bowman made a motion to approve 2^nd Reading of Ordinance 382 Amending Chapter 165 Zoning Regulations, seconded by Ramsey, all ayes, motion carried.

Borland made a motion to approve waiving 3^rd final Reading of Ordinance 382 Amending Chapter 1654 Zoning Regulations, seconded by Bowman. Roll call votes-all ayes, motion carried.

Sandy Marshall and Tyson Brown were present to discuss the driveway at 208 West Iowa. Vogel made a motion to approve a 32 feet opening at the curb line, rather than 25 feet which is the maximum width in the current ordinance, seconded by Borland, all ayes, motion carried. Marshall explained that this will be used to get into the garage, not for parking.

At 5:45 PM a Public Hearing was held for the purpose of discussing parking regulations. The City receives multiple complaints of vehicles parked in yards. The discussion was to not allow any vehicles to be parked in yards and does not include a driveway or temporary parking. Karen Zabel was present to express concerns of limiting residents to the number of vehicles they can have. It was discussed that people can park in driveways or on the street. Marshall talked about temporary parking and the time frame on that. Zabel asked if this would be complaint driven or will someone be seeking out these vehicles. Zimmerman explained the parking regulations process, in which these vehicles could receive parking tickets, as they currently do for parking in the front yard or a date to appear in court. Kitzman discussed that if the parking tickets are not effective, there is also the nuisance abatement procedure available that would be a higher fine, but a more lengthy process. This will not include inoperable vehicles, as they are treated as a nuisance.

At 6:10 PM Bowman made a motion to close the Public Hearing, seconded by Vogel, motion carried.

It was decided to move forward on drafting on ordinance for parking in yards. This will be on the next agenda.

Ramsey moved to adjourn the meeting, Vogel seconded, all ayes, motion carried. Meeting adjourned at 6:15 P.M.
